EB-1A is the fastest realistic route to a US green card for people with a genuine record of achievement. It is self-petitioned, requires no employer and no labour certification, and — critically for applicants born in backlogged countries — sits in a materially shorter queue than EB-2 or EB-3.
What EB-1A is
EB-1A is the "extraordinary ability" immigrant category. Its advantages compound:
- Self-petitioned. No employer, no job offer, no sponsor who can withdraw.
- No labour certification. The PERM process is skipped entirely.
- Priority-date advantage. EB-1 is generally current or far shorter than EB-2/EB-3 — the single biggest lever available to Indian- and Chinese-born applicants.
- Premium processing available on the I-140.
The standard: three of ten criteria, then final merits
You must demonstrate sustained national or international acclaim through a major internationally recognised award, or by meeting at least three of ten criteria:
Programme dossier

- Lesser nationally or internationally recognised prizes for excellence
- Membership in associations requiring outstanding achievement
- Published material about you in major media or trade publications
- Judging the work of others in your field
- Original contributions of major significance
- Authorship of scholarly articles
- Display of your work at artistic exhibitions or showcases
- Leading or critical role for distinguished organisations
- High salary relative to the field
- Commercial success in the performing arts
As with O-1A, meeting three criteria only gets you to the second stage. USCIS then makes a final merits determination on whether the record as a whole places you among the small percentage at the very top of your field, with sustained acclaim. Most refusals happen here, not at the criteria stage.
What actually persuades
Independent evidence beats volume. Citations that show genuine influence rather than raw counts; media coverage in outlets with editorial standards; judging or peer-review invitations from bodies you have no relationship with; adoption of your work by organisations that had no reason to favour you. Recommendation letters matter, but letters from independent experts far outweigh letters from co-authors and employers.
The strategic case for Indian-born applicants
If you were born in India and are sitting in an EB-2 or EB-3 queue, EB-1A is the most consequential question in your immigration plan. Two facts make it decisive:
- The queue is shorter. Per-country caps apply to EB-1 too, but demand is far lower, so final-action dates are dramatically more favourable than EB-2 India.
- Your priority date is portable. Move from EB-2 to EB-1A and you generally retain your original priority date — you are not restarting.
Confirm current final-action dates in the monthly Visa Bulletin, which moves monthly and can retrogress.
Building toward it
EB-1A rewards a deliberately constructed record. Accept judging and peer-review invitations. Publish. Pursue speaking slots and press coverage. If you are on O-1A, you are already assembling much of the evidence — the criteria overlap heavily, and O-1A approval, while not determinative, demonstrates a body of qualifying evidence.
If your record is not yet there, EB-2 NIW is the natural alternative: a lower bar, also self-petitioned, though in a longer queue.
