Croatia: The EU's Quietest Route to Citizenship

Every few years the investment-migration industry rediscovers a programme that was never a programme. Croatia is the current example, and most of what circulates about it is wrong in one direction or the other — either that Croatia sells passports, which it does not, or that there is no route at all, which is also not so.

Here is what the law actually provides, and who it is realistically for.

What Article 12 is

The Croatian Citizenship Act contains, at Article 12, a provision found in some form in many European nationality laws: a foreigner whose acceptance into citizenship would be in the interest of the Republic of Croatia may be naturalised even without meeting the standard requirements.

The waivers are what make it consequential. A qualifying applicant is exempt from the eight years of registered residence, from the Croatian language and Latin-script requirement, and from the obligation to be released from an existing citizenship. What always remains is respect for the Croatian legal order and a clean security profile — and the state's discretion, which runs the whole length of the process. The interest of the Republic must be established by a reasoned opinion of the competent ministry, and the Ministry of the Interior decides.

A spouse can follow the principal applicant after one year of authorised residence in Croatia.

Why it matters more than it did

Croatia in 2026 is not the Croatia this provision was written for. The country joined the EU in 2013 and, on 1 January 2023, joined the Schengen Area and the eurozone on the same day. Its passport now ranks 8th in the world with visa-free access to 182 destinations — ahead of the United Kingdom and the United States — and carries full EU rights of residence, work and establishment across the Union.

Since Malta's citizenship programme was closed by the Court of Justice in 2025, there is no formal citizenship-by-investment route anywhere in the European Union, and the court's reasoning forecloses any member state building one. What remain are the discretionary provisions: routes that cannot be bought, but can — for the right person — be earned.

Who it is for, and who it is not for

In practice, Article 12 has gone to internationally recognised scientists, artists and elite athletes — Croatia's national teams have been an occasional beneficiary — and to a small number of individuals whose contribution the state judged worth having.

For private applicants, the honest framing is this: it is a route for people of substantial standing who are prepared to make a serious, documented contribution to Croatia, and who can withstand full due diligence. Expect a seven-figure commitment. Expect scrutiny. And understand that no payment creates an entitlement — a weak candidacy fails at any price, which is precisely why the route retains its value.

It is not for anyone optimising on cost. The Caribbean programmes exist for that, at a fifth of the commitment, with the trade-offs we have covered at length.

Why we are not publishing the details

We hold the full picture — structure, sequencing, documentation, timeline — and we are deliberately not printing it. Partly because a discretionary grant described as a menu misleads: this is not a product, and pretending otherwise is how the industry earns its reputation. And partly because the work of assembling a credible Article 12 candidacy is exactly the work we only do for serious applicants.
